Terms of Use

Welcome to TrueToned ("TrueToned," "we," "our," or "us").

These Terms of Use ("Terms") govern your access to and use of the TrueToned website, Chrome browser extension, iOS application, and related services (collectively, the "Services").

TrueToned provides personalised seasonal colour analysis and colour-matching tools. Our Chrome extension offers colour-compatibility information on supported third-party retailer websites, while our iOS application provides standalone colour analysis, personalised palettes, and colour-scanning features.

By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

Your use of TrueToned is also subject to our Privacy Policy, available at https://www.truetoned.co/privacy-policy.


1. Eligibility

You must be at least 13 years old, or meet the higher minimum age required by applicable law, to use TrueToned. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

To access certain features, you may need to create a TrueToned account and provide accurate, current information.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.

  • Keeping your account information accurate and up to date.

  • Activities conducted through your account.

  • Notifying us promptly if you suspect unauthorised access to your account.


2. Your Account

You may not create accounts using false identities, share accounts in ways that compromise security, or attempt to bypass subscription restrictions or free-trial eligibility requirements.

We reserve the right to suspend or terminate accounts involved in fraud, abuse, unauthorised access, or material violations of these Terms, subject to applicable law.

You may request account deletion through available account settings or by contacting hello@truetoned.ca. Account deletion and personal information retention are explained in our Privacy Policy.


3. Description of the Services

TrueToned is a personal colour analysis platform designed to help users discover colours that complement their natural features and make more informed colour choices.

Personal Colour Analysis

TrueToned provides seasonal colour analysis using questionnaire responses, established colour-matching rules, and optional AI-assisted photograph analysis. Results are estimates and may vary depending on lighting, image quality, and other factors.

Chrome Browser Extension

Our Chrome extension provides personalised colour-compatibility ratings on supported third-party retailer websites based on your seasonal colour profile.

Supported retailers, available features, and website compatibility may change over time. TrueToned is an independent service and is not affiliated with, endorsed by, or sponsored by these retailers unless expressly stated otherwise.

TrueToned does not sell retailer products, process retailer purchases, or control third-party product listings, prices, availability, or return policies.

iOS Application

Our iOS application provides standalone seasonal colour analysis, personalised colour palettes, educational colour guidance, and colour-scanning tools.

The iOS application does not provide integrated retailer shopping or third-party retailer website functionality.

Service Availability

We may update, improve, modify, or discontinue features to maintain security, reliability, compatibility, or product quality.

We do not guarantee that every feature will remain available without interruption or that every third-party website will remain compatible with the Chrome extension.


4. Subscriptions, Free Trials, Billing, and Cancellations

Subscription Plans

TrueToned offers subscription-based access to certain features. Available plans, prices, currencies, and billing intervals are displayed at the time of purchase and may vary by country, platform, or promotional offer.

Seven-Day Free Trial

Eligible new subscribers may receive a seven-day free trial, as displayed during signup or checkout.

Unless cancelled before the trial expires, the subscription automatically converts to a paid subscription at the price and billing interval disclosed at checkout.

Free-trial eligibility may be limited to one trial per user or account. We reserve the right to prevent misuse of promotional offers, subject to applicable law and platform requirements.

Automatic Renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled.

By subscribing, you authorise the applicable payment provider to charge the disclosed subscription price, including applicable taxes, on a recurring basis until cancellation.

Chrome Extension Subscriptions

Subscriptions purchased through TrueToned's website or Chrome extension are processed through Stripe.

You may manage or cancel these subscriptions through the account or billing options made available by TrueToned, or by contacting hello@truetoned.ca.

iOS Subscriptions

Subscriptions purchased through the TrueToned iOS application are processed by Apple through In-App Purchases.

Apple manages billing, renewal, and cancellation for these subscriptions. You can manage or cancel your subscription through your Apple Account subscription settings.

Cancellation

You may cancel your subscription at any time. Cancellation generally prevents future renewals, and paid access ordinarily continues until the end of the current billing period.

Deleting the TrueToned application or your account does not necessarily cancel an active subscription. You must cancel through the applicable billing provider.

Refunds

Refunds for purchases processed by Apple are handled according to Apple's applicable refund procedures.

For subscriptions processed through Stripe, contact hello@truetoned.ca regarding refund requests. Refund eligibility is subject to applicable consumer protection laws and any refund terms disclosed at purchase.

Price Changes

We may change subscription pricing with appropriate advance notice where required. Any price changes will be handled in accordance with applicable law and the relevant payment platform's requirements.


5. User Content

You retain ownership of photographs, questionnaire responses, and other original content you submit to TrueToned.

By submitting content, you grant TrueToned a limited, non-exclusive licence to access, process, transmit, and use that content solely as reasonably necessary to provide, maintain, secure, and support the Services, consistent with our Privacy Policy.

This licence does not transfer ownership of your content to TrueToned.

TrueToned does not use your submitted photographs to train its own AI models. Third-party AI processing and applicable retention practices are described in our Privacy Policy.

Analysis Results

Colour-analysis results, seasonal classifications, personalised palettes, and recommendations are provided for your personal use.

You may use and share your personal results for non-commercial purposes. This permission does not grant ownership of TrueToned's underlying software, proprietary algorithms, branding, or original interface designs.

Feedback

If you voluntarily provide suggestions or feedback about TrueToned, we may use that feedback to improve the Services without compensation or obligation to you. This does not grant us ownership of your personal photographs or other submitted personal content.


6. Acceptable Use and restrictions

You agree to use TrueToned only for lawful purposes and in accordance with these Terms.

You may not:

  • Access or use the Services for fraudulent, unlawful, misleading, or harmful purposes.

  • Attempt to gain unauthorised access to TrueToned accounts, servers, databases, or other systems.

  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code, proprietary algorithms, or underlying technology of the Services, except where permitted by applicable law.

  • Copy, reproduce, distribute, resell, or commercially exploit TrueToned's software, designs, analysis methods, or content without prior written authorisation.

  • Use automated tools, bots, or scripts to interfere with the Services, bypass security measures, or abuse account or subscription systems.

  • Upload malicious code, harmful content, or photographs that violate another person's privacy or rights.

  • Misrepresent your identity, impersonate another person, or use another person's photograph for analysis without appropriate permission.

  • Interfere with the operation, security, or performance of the Services or other users' access.

You are responsible for ensuring that any information or photographs you submit are provided lawfully and that you have the necessary rights or permissions to use them.

We may investigate suspected misuse and restrict, suspend, or terminate access where reasonably necessary to protect the Services, users, or third parties, subject to applicable law.


7. Intellectual Property

The TrueToned name, branding, logos, website, Chrome extension, iOS application, software, interfaces, designs, original content, and proprietary colour-analysis and matching technology are owned by TrueToned or its applicable licensors.

These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purposes, subject to applicable law.

You may not reproduce, distribute, modify, sell, sublicense, or commercially exploit TrueToned's intellectual property without prior written permission, except as permitted by applicable law.


8. Third-Party Retailers, Services, and Links

TrueToned is an independent colour-analysis platform. Unless expressly stated otherwise, we are not affiliated with, sponsored by, endorsed by, or officially partnered with the third-party retailers whose websites are supported by our Chrome extension.

All third-party trademarks, logos, product names, and brand identities remain the property of their respective owners.

Retailer Websites and Product Information

Our Chrome extension may display colour-compatibility information alongside products on supported retailer websites.

TrueToned does not own, operate, or control these websites or their products, prices, availability, descriptions, photographs, shipping policies, or return procedures.

Colour-compatibility ratings are independent recommendations generated by TrueToned and do not represent claims or endorsements made by the retailers.

Purchases and Transactions

Any purchase made on a third-party retailer website is a transaction between you and that retailer.

TrueToned is not the seller of those products and is not responsible for retailer order fulfilment, shipping, product quality, refunds, or customer service.

Third-Party Services and Links

The Services may contain links to or rely on third-party platforms, including payment processors, app distribution platforms, and supported retailer websites.

Your interactions with those third parties may be governed by their own terms, policies, and privacy practices.

To the extent permitted by applicable law, TrueToned is not responsible for third-party websites, services, or content outside our control.

Compatibility and Availability

Retailer websites may change their layouts, technical systems, or access requirements without notice. Such changes may affect the availability or accuracy of Chrome extension features.

We do not guarantee uninterrupted compatibility with any particular retailer website.


9. Browser extension and related platform services

The TrueToned browser extension operates only while you voluntarily browse supported retailer websites.

The extension may analyze limited information displayed on webpages you actively choose to visit in order to provide personalized color recommendations, shopping insights, and related features.

TrueToned does not modify retailer checkout processes, process retailer payments, access retailer customer accounts, or represent itself as acting on behalf of any retailer.


10. AI Results, Accuracy, and Disclaimers

Nature of Colour Analysis

TrueToned provides personalised seasonal colour analysis, colour compatibility assessments, and educational recommendations using questionnaire responses, colour-matching rules, and optional AI-assisted photograph analysis.

Results are estimates intended for personal styling and informational purposes. They are not guaranteed to be accurate, complete, or suitable for every individual.

Factors Affecting Accuracy

Analysis results and colour recommendations may be influenced by lighting conditions, camera quality, image processing, screen calibration, makeup, hair colour, questionnaire responses, and other factors.

Colours displayed on screens may differ from their appearance in person. The colour-scanning feature may also produce different results depending on environmental conditions and device capabilities.

AI-Generated Information

Certain features may use artificial intelligence to assist with analysis or provide explanations. AI-generated information may contain errors, inconsistencies, or interpretations that differ from professional opinions.

Users should exercise their own judgment when relying on recommendations or making purchasing decisions.

No Professional Guarantee

TrueToned does not guarantee that its recommendations will produce a particular appearance, personal outcome, purchasing decision, or level of satisfaction.

Our Services are not a substitute for professional colour consultation where individualised expert assessment is required.

Service Disclaimer

To the extent permitted by applicable law, TrueToned provides its Services on an "as available" basis without guaranteeing uninterrupted access, compatibility with every device or retailer website, or error-free operation.

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.


11. User Responsibilities

You are responsible for:

  • Verifying product information before purchasing.

  • Using your own judgment when making purchasing decisions based on AI-generated recommendations.

  • Reviewing retailer policies.

  • Ensuring uploaded images belong to you or that you have permission to use them.

  • Protecting your account credentials.

  • Using the Services responsibly.


12. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, TrueToned disclaims all warranties, whether express or implied, including warranties of:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Availability

  • Accuracy

  • Reliability

We do not guarantee uninterrupted or error-free operation of the Services. Retailers may modify, redesign, restrict, or discontinue their websites or product information at any time. As a result, certain TrueToned features may become temporarily unavailable, require updates, or cease functioning without notice.


13. Limitation of Liability and Indemnification

Limitation of Liability

To the maximum extent permitted by applicable law, TrueToned and its owner, service providers, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including lost profits, lost opportunities, or losses resulting from reliance on colour recommendations.

TrueToned does not guarantee that its Services will be uninterrupted, error-free, or compatible with every device or third-party retailer website.

To the extent permitted by applicable law, TrueToned's total liability for claims arising from the Services will not exceed the amount you paid to TrueToned for the Services during the 12 months preceding the event giving rise to the claim.

Consumer Rights

Nothing in these Terms excludes, restricts, or limits any liability, warranty, remedy, or consumer protection right that cannot lawfully be excluded or limited.

The limitations above apply only to the extent permitted by the laws applicable to you.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TrueToned and its owner from third-party claims, damages, liabilities, and reasonable expenses arising directly from your unlawful use of the Services, intentional misconduct, or material violation of these Terms.

This obligation does not apply to the extent a claim results from TrueToned's own negligence, misconduct, or breach of applicable law.


14. Indemnification

You agree to indemnify and hold harmless TrueToned and its affiliates, officers, employees, contractors, and partners from any claims, damages, liabilities, costs, or expenses arising from:

  • Your use of the Services.

  • Your violation of these Terms.

  • Your violation of any applicable law.

  • Your infringement of another person's rights.


15. Termination and Changes to the Services

Termination by You

You may stop using TrueToned at any time and request deletion of your account through available account settings or by contacting hello@truetoned.ca.

Deleting your account or uninstalling the Chrome extension or iOS application does not automatically cancel an active subscription. Subscriptions must be cancelled through the applicable billing provider.

Suspension or Termination by TrueToned

We may suspend or terminate access to the Services where reasonably necessary due to:

  • Fraudulent, unlawful, or abusive activity.

  • Material violations of these Terms.

  • Security threats or unauthorised access.

  • Legal or regulatory requirements.

Where reasonably practicable, we will provide notice and an opportunity to address the issue before termination, unless immediate action is necessary to protect users, the Services, or third parties.

Changes to the Services

We may modify, improve, replace, or discontinue features for technical, operational, security, or business reasons.

Where a change materially affects a paid subscription, we will provide notice and any cancellation, refund, or other remedies required by applicable law.

Effect of Termination

Following termination, your right to access the Services may end. Certain provisions of these Terms, including intellectual property, liability limitations, and dispute-related provisions, may continue to apply where appropriate.

Personal information will be handled in accordance with our Privacy Policy and applicable retention requirements.


16. Privacy

Your use of the Services is also governed by our Privacy Policy.

By using TrueToned, you acknowledge that your personal information will be handled in accordance with our Privacy Policy.


17. Changes to the Services

We may update, improve, modify, suspend, discontinue, add, or remove any feature, supported retailer, browser compatibility, or functionality at any time without prior notice.

We are not liable for any modification, suspension, or discontinuation of the Services.


18. Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, business practices, legal requirements, or applicable regulations.

When changes are made, we will update the "Last Updated" date at the top of this page.

If changes materially affect your rights or obligations, we will provide additional notice where required by applicable law, such as through email, an in-app notification, or a notice on our website.

Your continued use of the Services after updated Terms take effect constitutes acceptance of those changes to the extent permitted by applicable law. Where affirmative consent is legally required, we will request it.

If you do not agree to updated Terms, you may discontinue using the Services and cancel any active subscription.


19. Data From Third-Party Websites

In order to provide the Services, TrueToned may process limited product information displayed on supported third-party retailer webpages that you actively choose to visit while using the browser extension to generate personalized recommendations, improve platform performance, and support enterprise personalization services, subject to our Privacy Policy. Such information is used solely to provide the requested functionality of the Services and remains subject to the applicable rights of the respective retailer or content owner.


20. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada, without regard to conflict-of-law principles.

This provision does not limit any mandatory consumer protection rights you may have under the laws of your province, state, or country of residence.

Resolving Disputes

If you have a concern or dispute relating to TrueToned, we encourage you to contact hello@truetoned.ca so we can attempt to resolve the matter informally.

We will make reasonable efforts to review and respond to concerns in a timely manner.

Legal Proceedings

Subject to applicable consumer protection laws and any mandatory jurisdictional requirements, disputes arising from these Terms may be brought before the courts of New Brunswick, Canada.

Nothing in this section prevents you from pursuing remedies or bringing proceedings in another jurisdiction where applicable law gives you that right.

No Mandatory Arbitration

These Terms do not require users to resolve disputes through mandatory private arbitration or waive their right to participate in legal proceedings where permitted by applicable law.


21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.


22. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and AI & Personalization Disclaimer, constitute the entire agreement between you and TrueToned regarding your use of the Services and supersede any prior agreements or understandings relating to the Services.
