Welcome to TrueToned ("TrueToned," "we," "our," or "us").

These Terms of Use ("Terms") govern your access to and use of the TrueToned website, browser extension, mobile application (when available), and all related products and services (collectively, the "Services").

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, please do not use the Services.


1. Eligibility

You must be at least 13 years of age, or the minimum legal age required in your jurisdiction, to use the Services.

By using TrueToned, you represent and warrant that you meet these eligibility requirements.


2. Your Account

Certain features may require you to create an account.

You agree to:

  • Provide accurate and complete information.

  • Keep your login credentials secure.

  • Maintain the confidentiality of your account.

  • Notify us immediately of any unauthorized access.

You are responsible for all activity occurring under your account.


3. Description of the Services

TrueToned provides an AI-powered Fashion Intelligence Platform designed to create more personalized shopping experiences for consumers while enabling enterprise personalization capabilities for fashion retailers.

Services may include:

  • AI-powered shopping recommendations

  • Personal Color Analysis

  • Personalized shopping experiences

  • Browser extension functionality

  • Retail integrations

  • Enterprise personalization services

  • Consumer insights and analytics

  • AI styling experiences

  • Future platform capabilities

TrueToned is an independent software service and browser extension that provides AI-powered color analysis and personalized shopping insights. Unless expressly stated, TrueToned is not affiliated with, endorsed by, sponsored by, or operated by any retailer, brand, marketplace, or manufacturer.

While you browse supported retailer websites, TrueToned may analyze limited product information available on the webpage you are actively viewing in order to generate personalized recommendations and extension features. TrueToned does not sell products, process retailer transactions, or control retailer websites. We may modify, improve, suspend, or discontinue any feature at any time.


4. Artificial Intelligence

TrueToned uses artificial intelligence and computer vision to generate recommendations.

While we strive for accuracy, AI-generated recommendations:

  • are estimates,

  • depend on image quality,

  • may change over time,

  • should not be considered guaranteed results.

AI-generated recommendations are provided for informational purposes only and should not be considered professional fashion, styling, cosmetic, medical, or purchasing advice. Individual preferences, lighting, photography, display settings, and retailer color naming conventions may affect results. Additional information can be found in our AI & Color Analysis Disclaimer.


5. User Content

You retain ownership of any photographs, images, or other content you upload.

By uploading content, you grant TrueToned a limited, non-exclusive, worldwide license to process, analyze, store, and display your content solely for the purpose of providing the Services.

This license ends when your content is deleted from our systems, except where retention is required by law.


6. Acceptable Use

You agree not to:

  • Violate any applicable laws.

  • Upload unlawful or harmful content.

  • Attempt to interfere with the Services.

  • Reverse engineer our software.

  • Circumvent security measures.

  • Use automated bots without authorization.

  • Copy, reproduce, distribute, or attempt to reverse engineer our proprietary technology.

  • Impersonate another individual.

  • Upload malicious software or viruses.

  • Misuse the Services in any way that harms other users or TrueToned.

Violation of these Terms may result in suspension or termination of your account.


7. Intellectual Property

All intellectual property relating to the Services, including but not limited to:

  • Software

  • Algorithms

  • Artificial intelligence models

  • Website content

  • Browser extension

  • Logos

  • Graphics

  • Branding

  • Text

  • Designs

  • User interface

  • Databases

is owned by TrueToned or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

Product names, descriptions, images, trademarks, logos, pricing, availability, and other retailer-provided content remain the property of their respective owners. TrueToned does not claim ownership of third-party retailer content.


8. Third-Party Retailers

TrueToned provides personalized recommendations relating to products offered by independent third-party retailers.

TrueToned may also collaborate directly with retailers through pilot programs, enterprise partnerships, or technology integrations. Unless expressly stated, such collaborations do not affect the independence of AI-generated recommendations.

TrueToned does not:

  • Sell products directly.

  • Process retailer payments.

  • Control retailer pricing.

  • Control inventory.

  • Control shipping.

  • Control return or exchange policies.

  • Control product availability.

  • Control retailer product descriptions or imagery.

  • Guarantee the accuracy of retailer information.

Product information displayed by retailers, including colors, descriptions, pricing, availability, sizing, and images, may change at any time. Users are responsible for verifying product details directly with the retailer before making a purchase.

Purchases made through third-party retailers are solely between you and the applicable retailer.


9. Browser extension and related platform services

The TrueToned browser extension operates only while you voluntarily browse supported retailer websites.

The extension may analyze limited information displayed on webpages you actively choose to visit in order to provide personalized color recommendations, shopping insights, and related features.

TrueToned does not modify retailer checkout processes, process retailer payments, access retailer customer accounts, or represent itself as acting on behalf of any retailer.


10. Affiliate Links

Some product links may be affiliate links.

If you purchase products through these links, TrueToned may receive a commission at no additional cost to you.

Some product links may include affiliate relationships where applicable.

Affiliate relationships do not influence our AI-generated recommendations.


11. User Responsibilities

You are responsible for:

  • Verifying product information before purchasing.

  • Using your own judgment when making purchasing decisions based on AI-generated recommendations.

  • Reviewing retailer policies.

  • Ensuring uploaded images belong to you or that you have permission to use them.

  • Protecting your account credentials.

  • Using the Services responsibly.


12. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, TrueToned disclaims all warranties, whether express or implied, including warranties of:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Availability

  • Accuracy

  • Reliability

We do not guarantee uninterrupted or error-free operation of the Services. Retailers may modify, redesign, restrict, or discontinue their websites or product information at any time. As a result, certain TrueToned features may become temporarily unavailable, require updates, or cease functioning without notice.


13. Limitation of Liability

To the fullest extent permitted by law, TrueToned, its officers, employees, affiliates, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Services. TrueToned is not responsible for the availability, accuracy, completeness, security, or continued operation of third-party websites or services.

This includes, but is not limited to:

  • Purchasing decisions

  • Product dissatisfaction

  • Retailer errors

  • Lost profits

  • Data loss

  • Service interruptions

  • Technical issues

  • AI-generated recommendations

  • Changes made by third-party retailers to their websites, products, pricing, or services.

Your use of the Services is at your own risk.


14. Indemnification

You agree to indemnify and hold harmless TrueToned and its affiliates, officers, employees, contractors, and partners from any claims, damages, liabilities, costs, or expenses arising from:

  • Your use of the Services.

  • Your violation of these Terms.

  • Your violation of any applicable law.

  • Your infringement of another person's rights.


15. Suspension and Termination

We reserve the right to suspend or terminate access to the Services at our sole discretion if we reasonably believe that:

  • These Terms have been violated.

  • The Services are being misused.

  • Continued access may harm TrueToned or other users.

  • We are required to do so by law.

Termination does not affect any rights or obligations that accrued before termination.


16. Privacy

Your use of the Services is also governed by our Privacy Policy.

By using TrueToned, you acknowledge that your personal information will be handled in accordance with our Privacy Policy.


17. Changes to the Services

We may update, improve, modify, suspend, discontinue, add, or remove any feature, supported retailer, browser compatibility, or functionality at any time without prior notice.

We are not liable for any modification, suspension, or discontinuation of the Services.


18. Changes to These Terms

We may revise these Terms from time to time.

When material changes are made, we will update the "Last Updated" date.

Continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.


19. Data From Third-Party Websites

In order to provide the Services, TrueToned may process limited product information displayed on supported third-party retailer webpages that you actively choose to visit while using the browser extension to generate personalized recommendations, improve platform performance, and support enterprise personalization services, subject to our Privacy Policy. Such information is used solely to provide the requested functionality of the Services and remains subject to the applicable rights of the respective retailer or content owner.


20. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of New Brunswick, Canada, unless otherwise required by applicable law.


21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.


22. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and AI & Personalization Disclaimer, constitute the entire agreement between you and TrueToned regarding your use of the Services and supersede any prior agreements or understandings relating to the Services.
